Below, we inform you about which personal data we collect and store when you use our portals, how we use this data, and with whom we may share this data. You will also receive information about your rights regarding our use of your data:
2. Scope and purpose of processing personal data
2.1 When visiting our portals
If you use our digital offerings without providing any further information, the web server technology we use automatically records general technical visit information in so-called log files. This includes, among other things, the IP address of the device used to access the site, information about the browser type, the Internet service provider, and the operating system used, which of our digital offerings were accessed, reference/exit pages, and the time and duration of the visit.
This information is collected and processed to enable the use of our websites (establishing a connection), ensure system security and stability, analyze the use of our offers and services, collect general demographic information, and enable the optimization of our internet offering (in particular, but not exclusively, product improvements, marketing measures, target group-specific advertising, etc.), as well as for internal statistical purposes. Users are not identified in this process. Likewise, no connection is generally established between this automatically collected information and personal data stored by us. However, an exception to this general rule may exist if you already have a registered user account on one of our portals. Regarding the processing of personal data of registered users, you will find further detailed information in sections 1.b and 1.c below.
If you send a message to a third party (e.g., an advertiser) using a corresponding function on our portal, we may store it. You can also receive free services on our portal. Any personal data you provide when using a free service or with the message (email address, telephone number, etc.) may be used by us for marketing and analysis purposes, for example. More detailed information on the processing of personal data for marketing and analysis purposes can be found below in Section 4.
We may publish information published by you on our portal on other platforms and in other media (such as newspapers), possibly in an adapted form.
In addition, we use cookies and analysis tools (e.g., Google Analytics) when you visit our portals. For more information, see sections 8 and 9 of this privacy policy.
2.2 When registering a user account
For personalized services or access-protected areas, or to process inquiries and administer your subscriptions, you may be required to register and thus create a user account. This requires the entry of certain personal data. This applies, for example, to
- Your email address, which can also serve as your username,
- Password
and, depending on the context and offer, further information such as
- First and Last Name
- Address (full postal address, postal code, city)
- Phone number
- Date of Birth
- Gender
- Information about subscribed newsletters or other advertising;
- language preferences
In addition to the information marked as mandatory for the use of a particular digital service, you can voluntarily enter and save further personal data.
We use the data to process and administer our digital offerings, to check the plausibility of the data entered, i.e. to establish, design the content, process and amend the contractual relationships concluded with you via your user account and, in the case of paid services, for proper invoicing.
If you post contributions (comments, photos, videos, etc.) using the relevant functions on our portals to share them with other users, we may publish them and thus make them accessible to the public. This also applies to your username or any nickname you may have chosen for this purpose. We would like to point out that such data, once published online, may still be accessible to third parties, for example, via search engines, even if you or we initiate deletion or anonymization.
By confirming the recording and modification of your user account information when completing the registration process, you guarantee the accuracy of the information you have entered.
2.3 When using a portal as a registered user
During the use of the portal by registered users, we collect data for statistical purposes, to ensure the smooth functioning of the portal, and to analyze, optimize, and personalize the use of our offers and services. We collect data about whether and how you use our digital offerings, in particular which functions and advertising you perceive and how. Further information on the processing of this personal data can be found below in Section 1.d and Section 4.
If you use our portal as a registered user, statistical data may be visible to other registered users and may be collected and evaluated by us.
2.4 When purchasing / obtaining a paid service
If you purchase a product or use a paid service on our website, you are required to provide information such as your first and last name, address (full postal address, postal code, city), and any other data, as we need this to process the contract with you. If you choose an online payment option such as credit card or PayPal to purchase a product or a paid service, payment will be made via the respective provider's online payment system. In this case, personal and payment data will be processed directly by the provider of the respective payment system. We do not know or store your payment data. The data protection regulations of the respective online payment system provider also apply.
If you are registered and have a user account, we can save your data in the user account for the next purchase / conclusion of a contract.
In any case, we store all information about your current and previous purchases and contracts, i.e., the products, services, the number of products and services per purchase, and the payment amount. You hereby agree that we may use this information for marketing and analysis purposes. The analysis of your user and purchasing behavior may result in sensitive personal data or personality profiles.
Further information on marketing and analysis purposes can be found below in section 4.
3. Consent
By collecting and modifying your information, you consent to the processing, use and disclosure of the same within the scope and scope of the purposes described in this privacy policy.
4. Email advertising / online advertising
By registering or placing an order as a guest on one of our portals, you consent to us using your personal data for personalized advertising measures. This applies both to the personalization of advertising via email, such as emails with general information or promotional content (newsletters), as well as the delivery of personalized content and advertising on our portals. For this purpose, we may automatically evaluate information about your usage behavior on our portals.
By registering a user account, you automatically subscribe to one of our newsletters, and your email address may be used for our own advertising purposes until you unsubscribe from the respective newsletter. At the end of every email sent by Neubau Portal AG, you will find a link that you can use to unsubscribe from the newsletter at any time. We are entitled to commission third parties with the technical processing of advertising measures and are entitled to share your data for this purpose (see Section 3 below).
5. Processing your personal data for marketing and analysis purposes
The companies of Neubau Portal AG aim to continuously improve the digital services they offer and to tailor them to meet customer needs.
For this purpose, we can continuously link user-specific historical and future data available to us using various analysis tools, and analyze user behavior across all services. The insights gained from your use of our services can be used and exploited as part of the analysis of user behavior by other participating companies.
Any objection you may make does not completely exclude the collection of personal data. The objection merely prevents collected personal data from being processed anonymously for marketing purposes and from being forwarded to and analyzed by other companies for this purpose. To completely exclude or at least reduce the collection of personal data, the steps mentioned in Section 8 regarding deactivating cookies must be followed. This may result in you no longer being able to receive or use the services you have requested.
6. Transfer of data to third parties
We work with other companies or individuals, or commission other companies or individuals to process and store data. These companies or individuals may have access to your personal data or usage data, but only to the extent necessary to perform their tasks.
6.1 Transfer of data to affiliated companies
We may use and share information collected from you and data about you or your user account collected as part of our usage measurements in accordance with Section 1 above with Neubau Portal AG companies (Neubauprojekte.ch, Erstbezug.ch, Neubau.ch) for the purpose of evaluating, improving, and tailoring our services or the services of our affiliated companies to meet your needs, for customer care, personalization, and marketing purposes. Data processing by other Neubau Portal AG companies is described below in Section 4.
We also share your data with third parties if necessary to process the contract. For this purpose, we may share the required data with transport companies, banks, and other service providers. These service providers use your data exclusively for order processing and not for any other purposes. For example, the data of buyers of our premium subscription is shared with SMZH, which supports customers during the purchasing process and does not use the data for any other purposes. If necessary for the purposes stated in sentence 1, the data may also be shared abroad, for example, to facilitate the delivery of goods.
We do not sell, rent or trade any personal data you provide to us outside of Neubau Portal AG.
Apart from the disclosures described above, we will only disclose your personal data if you have expressly consented to this, if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship.
If we sell, merger, or otherwise reorganize some or all of our company's assets, personal information may be transferred, sold, or otherwise shared with third parties as part of that transaction or reorganization.
If we make advance payments, for example, when purchasing on account, we may obtain a credit report from a credit agency based on mathematical and statistical procedures to protect our legitimate interests. For this purpose, we transmit the personal data required for a credit check to a credit agency and use the information obtained regarding the statistical probability of a payment default to decide on the establishment, implementation, or termination of the contractual relationship. The credit report may contain probability values (score values) calculated based on scientifically recognized mathematical and statistical procedures, which include, among other things, address data. Your legitimate interests will be taken into account in accordance with statutory provisions.
6.2 Transfer of advertisement data to third-party platforms
The listing data published on this website may be shared with third parties, particularly partner platforms in the real estate sector. In this case, the listing data will be transmitted to the comparis.ch platform in compliance with applicable data protection laws. By transmitting the listing data to comparis.ch, you as a user agree that this data is subject to the General Terms and Conditions (GTC) and the privacy policy of comparis.ch.
7. Transfer of personal data abroad
We are entitled to transfer your personal data to third-party companies (contracted service providers) abroad, provided this is appropriate for the data processing described in this privacy policy. These companies are subject to the same data protection obligations as we are. If the level of data protection in a country does not correspond to that in Switzerland, we contractually ensure that the protection of your personal data corresponds to that in Switzerland at all times.
8. Right to information, correction or deletion
You have the right to exercise your data protection rights at any time and to request information about whether and which personal data about you is processed by us. You can also have your personal data corrected, blocked, or deleted at any time by sending a written notification and appropriate proof of identity to the following address:
We reserve the right to correspond with you in this regard.
Please note that even after you request that we block or delete your personal data, we may still be required to retain some of it due to our legal or contractual retention obligations (e.g., for billing purposes). In this case, we will only block your personal data to the extent necessary for this purpose. Furthermore, deleting your personal data may prevent you from receiving or using the services you have registered for.
9. Data security
We use appropriate technical and organizational security measures to protect your personal data stored with us against accidental, unlawful, or unauthorized manipulation, deletion, alteration, access, disclosure, or use, as well as against partial or total loss. Our security measures are continuously adapted and improved in line with technological developments. We assume no liability for the loss of data or its access and use by third parties.
If you register with us as a user, access to your user account is only possible after entering your personal password. You should always treat payment and access information confidentially and close the browser window when you have finished communicating with us, especially if you share your computer with others.
10. Cookies
Cookies help make your visit to our website easier, more enjoyable, and more meaningful. Cookies are information files that your web browser automatically stores on your computer's hard drive when you visit our website.
Cookies do not damage your computer's hard drive, nor do they transmit any personal data of users to us.
For example, we use cookies to track who has visited our portals and to determine how often certain pages or offers are visited, which parts of the respective portal are particularly popular and, in general, to record how the portals are used. We use other cookies so that you can move freely around our portals and use their functions, such as accessing restricted areas. Such cookies may also be required to use shopping carts or payment functions. Cookies can also be used to store options you have chosen or decisions you have made as settings to make your visit to the portals more convenient. In general, cookies are used to improve our services and to make them more effective and secure. Cookies are also used to collect information in order to offer you advertising that may be of interest to you. Most internet browsers accept cookies automatically. However, you can configure your browser at any time so that no cookies are stored on your computer or so that a notification always appears when you receive a new cookie.
Our digital offerings can generally be used without accepting cookies, although certain functionalities may then be restricted.
11. Tracking and analysis tools
The use of our digital offerings is also measured and evaluated using various technical systems, primarily from third-party providers such as Google Analytics. These measurements can be carried out both anonymously and on a personal basis. It is possible that the data collected by us or the third-party providers of such technical systems will in turn be passed on to third parties for processing. The most frequently used analysis tool is Google Analytics, a service provided by Google Inc. This allows the collected data to be transmitted to a Google server in the USA. IP addresses are anonymized using IP anonymization, making it impossible to assign them to that server. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. You can object to the collection and processing of this data by Google Analytics by setting an opt-out cookie, which prevents the future collection of your data when you visit this website: http://tools.google.com/dlpage/gaoptout?hl=de
12. Plug-ins and other integrations of third-party offers
Our digital offerings are linked to third-party functions and systems in a variety of ways, for example through the integration of plug-ins from third-party social networks such as Facebook, Google Plus or Twitter.
If you have a user account with these third parties, these third parties may also be able to measure and evaluate your use of our digital offerings. In doing so, additional personal data, such as your IP address, personal browser settings, and other parameters, may be transmitted to these third parties and stored there. When using a social login service such as Facebook Connect, the provider may transmit to us personal data stored about you, such as your name, email address, and profile picture. We have no control over the use of such personal data collected by third parties and assume no responsibility or liability. We refer to the detailed, further information on this subject linked above.
13. YouTube API
We sometimes use services from YouTube and Google on our platforms.
The YouTube terms of use can be found here: https://www.youtube.com/t/terms
